Nicholas Gilbert's students at West Clermont Middle School in Clermont County knew him as their teacher. A grand jury indictment now alleges that four of them were also his victims.
Gilbert, 32, of Williamsburg Township, was indicted April 2 on four counts of sexual battery, each charged as a fourth-degree felony under Ohio law, after four juvenile students reported inappropriate and unwanted physical contact that occurred during school hours. The grand jury structured the charges one count per victim, reflecting the scope of what investigators say was repeated conduct across multiple incidents while students were under his supervision.
The investigation traces back to February 5, when a parent filed a concern with school authorities about a staff member's behavior at West Clermont Middle School. Clermont County Sheriff's Office detectives moved in, interviewed school officials, and identified four separate juvenile victims. Investigators determined the alleged incidents occurred on multiple occasions during the school day. When detectives first contacted Gilbert during the probe, he declined to speak. He was placed on administrative leave as the allegations became known.
Under Ohio law, sexual battery applies when sexual conduct occurs in circumstances where the offender holds a position of authority over the victim, a category that explicitly covers the teacher-student relationship. That distinction separates this charge from a broader assault statute and reflects the law's recognition that the institutional trust placed in educators creates a specific category of harm. As a fourth-degree felony, each count carries potential prison time, and a conviction could also trigger mandatory sex offender registration requirements depending on how the court proceeds at sentencing.
School administrators confirmed that West Clermont Schools responded immediately after the February 5 report and cooperated fully with the sheriff's investigation throughout. Counseling resources have been made available to affected students and families in the district.
