Gerson Jonathan Melgar Gutierrez, 28, of Storm Lake, allegedly forced his way into his domestic partner's apartment in the 100 block of East Railroad Street and assaulted her before fleeing, only to be arrested minutes later a few blocks away on Irving Street.

Storm Lake Police responded to the address at approximately 8:25 a.m. on March 30 following a report of a domestic disturbance. Officers arrived to find the victim with bodily injuries. Buena Vista Regional Medical Center paramedics treated her at the scene. Police then located Melgar Gutierrez in a vehicle in the 300 block of Irving Street and took him into custody without incident.

Booked into the Buena Vista County Jail, Melgar Gutierrez faces five counts: first-degree burglary, a Class B felony; willful injury causing bodily injury, a Class D felony; domestic abuse assault causing bodily injury; criminal mischief; and obstruction of emergency communications. Bond was set at $30,600.

The first-degree burglary count, Iowa's most serious burglary classification, carries up to 25 years in state prison. The charge applies when a person enters an occupied structure without authorization with the intent to commit a felony or assault, which is why forcing entry into a domestic partner's home can elevate what might otherwise be a standalone assault charge into a major felony. The obstruction of emergency communications count signals prosecutors believe Melgar Gutierrez interfered with the victim's ability to call for help, a factor that can weigh significantly in sentencing if a conviction follows.

The case will proceed through Buena Vista County District Court, where filings will be publicly accessible through Iowa Courts Online. At arraignment, the court will consider conditions of release, including whether a no-contact order is warranted. No-contact orders in domestic assault cases prohibit any communication between the defendant and the victim and are routinely sought when physical injury has occurred. The $30,600 bond reflects a judicial finding that the charges carry meaningful risk of reoffense or flight.

Melgar Gutierrez is presumed innocent unless and until proven guilty in court.
