Honduran Man Charged in Knife Assault at Helena Dairy Queen

Jorge Samuel Lopez Bardales, 27, was charged with felony assault with a weapon in Lewis and Clark County Justice Court Friday after Helena police say he drew a knife on a man during a midday confrontation in the parking lot of the Dairy Queen at 1700 Prospect Ave.
The dispute started on the road. According to charging documents, Bardales cut off another driver on Prospect Avenue around 12:30 p.m. Thursday, and both vehicles pulled into the Dairy Queen lot. After a verbal argument, the victim pushed Bardales away from him. Bardales then reached into his right pocket, pulled out a knife and swung it at the man. A bystander who witnessed the encounter corroborated that account, and surveillance footage from the restaurant captured both vehicles entering the lot and the two men arguing outside.
Bardales told law enforcement he drew the knife only after the other man "pushed or punched" him in the chest. The court complaint describes the surveillance footage differently: "The defendant takes several steps toward the victim with the knife blade out, while the victim retreats and puts his arms up to defend himself."
During booking at the Lewis and Clark County Detention Center, officers found Bardales had no valid ID or passport. He was identified as a Honduran national through paperwork linked to the South Texas ICE Processing Center.

Felony assault with a weapon in Montana carries a maximum penalty of 20 years in prison and a $50,000 fine.
Sheriff Leo Dutton addressed questions about immigration enforcement head-on. "He will be seen by the court and go through the process," Dutton said. "As long as there are criminal charges, we will hold him." Dutton confirmed Bardales would not be transferred to federal immigration officials, despite his undocumented status. Bardales remained at the Lewis and Clark County Detention Center as of Friday.
Anyone who witnessed the incident at the Prospect Avenue Dairy Queen and has not yet spoken to law enforcement should contact the Helena Police Department. No bail amount or next court date had been publicly announced as of Sunday.
