McDowell County Faces Public Records Request Over Opioid Settlement Funds

A public-records request filed Wednesday is pushing McDowell County Commission to account for opioid settlement funds the county has received, raising questions about how that money is being managed and where it will go.

Maxine Brock submitted the request on March 12, 2026 through MuckRock, a platform widely used by journalists and civic watchdogs to file and track public-records requests. The filing targets the McDowell County Commission directly, seeking documentation that would reveal the amounts the county has received from opioid settlements and, critically, how those funds are intended to be spent.

Opioid settlement money flowing to counties across the country stems from multi-billion dollar agreements reached with pharmaceutical manufacturers and distributors held responsible for fueling the opioid crisis. McDowell County, long among the hardest-hit communities in West Virginia, has faced devastating rates of overdose deaths and addiction over the past two decades. How local governments choose to deploy settlement dollars, whether toward treatment, recovery housing, harm reduction, or other services, carries significant consequences for residents still living through that crisis.

The MuckRock request does not itself compel the Commission to act in any particular way, but it does require a formal response under West Virginia's Freedom of Information Act. The county must either produce the requested records or provide a legally sufficient reason for withholding them.

As of publication, the McDowell County Commission had not publicly responded to the request.
