Michael Smith, 25, is now facing felony-level accusations after Kentucky State Police say a minor ended up hospitalized following an alcohol-related incident tied to a Dec. 4 encounter.

According to a summons taken out by KSP Trooper Ryan Couch, Smith, of Acup Road in Happy, allegedly bought alcohol for a minor. The case moved into the criminal system after the child’s mother later found the minor passed out and took the child to the emergency room, a detail that underscores how quickly underage drinking can turn into a medical crisis.

Smith was charged with wanton endangerment and unlawful transaction with a minor. In Kentucky, first-degree wanton endangerment means wantonly engaging in conduct, under circumstances showing extreme indifference to human life, that creates a substantial danger of death or serious physical injury. It is a Class D felony, one of the state’s more serious lower-level felony charges.

The unlawful-transaction-with-a-minor charge is separate. Kentucky law makes it a crime for someone other than a retail licensee to knowingly sell, give, purchase or procure alcoholic beverages for a minor. In this case, investigators say the alcohol was allegedly obtained for a child, then became part of an incident that required emergency medical treatment.
