Somerton Reviews Zoning Changes for Shade Structures, AC Screening Under State Law
Somerton's Planning & Zoning Commission reviewed zoning changes for shade structures and rooftop AC screening on March 16 to comply with state law HB 2447.

Somerton's Planning & Zoning Commission took up proposed zoning code changes tied to a new state law last week, placing shade structure rules and rooftop air conditioning screening requirements before the public for input at a citizen review meeting held March 16.
Planner I Priscila Ochoa, identified as the presenter in the formal meeting packet and agenda, led the session on behalf of the Community Development Department. The proposed text amendment is intended to bring Somerton's zoning ordinance into compliance with HB 2447, a new state law whose requirements prompted the city to revisit existing code language governing both shade structures and how rooftop AC equipment must be screened from view.
The citizen review format is a routine step in Somerton's zoning amendment process. Under Arizona law, specifically A.R.S. § 38-431.01(G), any action the commission takes as a result of public comment at such a meeting is limited to directing staff to study the matter, responding to criticism, or scheduling the item for further consideration and a formal decision at a later date.
The city has used these sessions to work through a range of code updates in recent years. In April 2021, the commission conducted a similar citizen review at Somerton City Hall's Council Chambers, 143 N. State Ave., to consider zoning text amendment case PLN21-00013, which proposed changes to marijuana establishment regulations, swimming pool barrier requirements, and K-8 school location requirements under the Somerton Zoning Ordinance.
The March 16 meeting packet did not include a case number in the available materials, and the full text of the proposed amendments, including specific code language for shade structures and AC screening, had not been publicly released as of this report. A complete record of public comment, staff findings, and any commission direction from the session is expected to appear in the official minutes.
