If you haven’t received minimum wage or overtime pay and are covered by the Fair Labor Standards Act, you may consider filing a wage complaint with the U.S. Department of Labor. As of March 2025 the federal minimum wage is $7.25 an hour, and many states require higher rates that employers must follow.

The Wage and Hour Division (WHD) of the U.S. Department of Labor (DOL) administers and enforces the FLSA with respect to private employment, State and local government employment, and Federal employees of the Library of Congress, U.S. Postal Service, Postal Rate Commission, and the Tennessee Valley Authority. The FLSA establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. The Department may file suit on behalf of employees for back wages, an equal amount in liquidated damages, and civil money penalties where appropriate. The Department may seek a U.S. District Court injunction to restrain violations of the law, including the unlawful withholding of proper minimum wage and overtime pay, failure to keep proper records, and retaliation against employees who file complaints and/or cooperate with the Department. The Department may seek an order for payment of civil money penalties from a U.S. Department of Labor Administrative Law Judge where appropriate. Revised November 2023.

You can file by online submission, by phone, by mail, or in person at a WHD office. The Labor Department has a toll-free number for information, questions, and concerns; the WHD toll-free line is 1-866-487-9243, also shown as 1 866-4-US-WAGE. To start, "Gather information to file your complaint:" include your name, address, and telephone number; the name, address, and telephone number of the employer or employment agency; the manager or owner’s name; a description of the type of work you did; when the events took place; and how and when you were paid.

"Your complaint will get routed to the nearest field office, and they will contact you within two business days." WHD staff "will work with you to answer your questions and determine whether an investigation is the best course of action." If an investigation is set up and finds sufficient evidence, "you’ll receive a check for lost wages." "Complaints are confidential." Third parties can file complaints for an employee denied proper wages, and "Immigration status is not important. Undocumented workers can file complaints over federal wage law and wage payment violations."
