Three Arrested After Theft in Progress at Wauwatosa Home Depot
Three people were arrested after a reported theft at the Wauwatosa Home Depot; conflicting accounts of a pursuit and timing matter for Loss Prevention and employee safety.

Wauwatosa police responded to a reported retail theft at the Home Depot on 124th Street and took multiple people into custody, an incident that exposed conflicting accounts about whether a short parking-lot detention or a multi-mile pursuit occurred. The discrepancy has implications for Loss Prevention staff and store associates who face rising retail theft and safety concerns.
Local news outlets reported different sequences. WISN said the response occurred just before 1:45 p.m. on Jan. 30, 2026, and that officers “found three people trying to drive away,” contained the vehicle in the parking lot, and that “one person tried to run away, causing a short foot chase. Eventually, all three were arrested on scene.” WISN quoted the Wauwatosa Police Department as saying, “The Wauwatosa Police Department said there was a short foot chase with one of the suspects.”
Fox6 offered a different version, reporting that “a second chase began around 5:15 p.m. Officers responded to a Home Depot near 124th and Capitol for retail theft and tried to stop a vehicle, but a pursuit ensued.” According to Fox6, “Police used a tired [sic] deflation device, and the chase ended a little more than five miles from where it began near 84th and Villard when the fleeing vehicle crashed into a light pole.” Fox6 added, “Three people got out and ran. Two of the three were arrested, while the third was not found. It was later learned the vehicle was reported stolen.”
Separately, Menomonee Falls Police Department records link an earlier retail theft case to merchandise recovered during a Wauwatosa arrest. Menomonee Falls noted that “The Wauwatosa Home Depot Loss Prevention contacted the Menomonee Falls Police Department and reported a retail theft from the Menomonee Falls Home Depot store. This report was prompted by a retail theft at the Wauwatosa location, where the Wauwatosa Police Department responded.” The department said, “During the subject’s arrest, the Wauwatosa Police Department found over $1,000 of unpaid merchandise stolen from the Menomonee Falls Home Depot in the subject’s possession.” Menomonee Falls added that “The subject was arrested by the Wauwatosa Police Department, refused a statement, and was transported to the Milwaukee County Sheriff’s Office Jail,” and that “A felony charge of Retail Theft for the incident in Menomonee Falls has been referred to the Waukesha County District Attorney’s Office for review.” The Menomonee Falls case referenced in their release is case 25-031072, dated 12/06/2025.

The variations in reporting, the number arrested on scene, whether a pursuit occurred, the times listed, and the connection to a December case in Menomonee Falls, leave several open questions about the exact sequence and the charges filed by Wauwatosa police. For front-line Loss Prevention teams and hourly associates, clarity matters: physical safety protocols, methods for vehicle containment, and coordination with local police can differ depending on whether incidents escalate into vehicle pursuits.
Retail theft continues to strain store operations, with Loss Prevention teams often coordinating across stores and with multiple police agencies. This episode highlights the operational burden of tracking cross-store thefts, documenting recovered property, and processing felony referrals such as the one sent to the Waukesha County District Attorney’s Office.
Officials have provided differing accounts so verification of the timeline, the number of arrests, and the relationship between the Menomonee Falls case and the Wauwatosa response remains important. How Wauwatosa Police Department and Home Depot Loss Prevention reconcile these details will determine any follow-up charges and the adjustments stores make to protect employees, deter theft, and limit escalation during confrontations.
