Buena Vista County Board Convenes Special Session on Roads, Litigation

The Buena Vista County Board of Supervisors convenes a special session this morning at 8:30 a.m. in the Boardroom, with remote participation available via GoToMeeting. The amended agenda schedules presentations from Engineer Bret Wilkinson and Environmental Health/Zoning Director Ben Mueggenberg, a public comment period, routine approvals, and a possible closed session with County Attorney Paul Allen under Chapter 21.5(1)(c) of the 2026 Code of Iowa to discuss litigation strategy.

A five-minute public comment period is scheduled at 9:00 a.m., providing residents a formal opportunity to address the board before it moves into approvals and reports at 9:05 a.m., including approval of minutes from January 2, 2026, and acceptance of submitted reports. The agenda notes that no reports were submitted for review and acceptance, meaning the board’s actions on routine reports may be limited.

At 9:15 a.m., County Attorney Paul Allen will ask the board to consider a closed-session discussion described under Iowa law for matters in litigation or where litigation is imminent. The board’s use of Chapter 21.5(1)(c) is a permitted restriction on public access when disclosure would likely prejudice the county’s legal position; such sessions reduce public visibility into strategy while protecting the county’s legal interests.
