The parents of an unnamed 14‑year‑old first‑year high school student filed a $1,000,000 civil lawsuit in Collin County on Feb. 26, naming McKinney Independent School District and former athletic trainer Lindsey Elizabeth Post as defendants and alleging Post repeatedly took the child off campus and sexually assaulted the minor. Post was arrested by the McKinney Police Department on Jan. 28 on charges that include sexual assault of a child and improper relationship between an educator and a student; she was booked into the Collin County Jail and posted a $125,000 bond.

Herz Law, which is representing the family, said in a Jan. 28 press release that the student’s complaint alleged “instances of rape over several months, corroborated by the immediate investigation of the McKinney Police Department,” and that a warrant issued for the arrest of Ms. Lindsey Post, whom the firm identified as a 35‑year‑old athletic trainer employed by the ISD. McKinney North High School is listed in reporting as Post’s primary assignment, with additional support duties at Cockrill Middle School and Scott Johnson Middle School.

The civil complaint filed Feb. 26 alleges parents discovered the conduct after viewing material on their child’s phone and that Post offered to drive the student to a school‑sponsored off‑campus event because McKinney ISD allegedly did not provide transportation. The suit alleges Post “hugged and kissed the teen at school and later lured the student into her car, where the assaults occurred,” and it asserts the off‑campus takings and assaults happened multiple times. The filing characterizes the conduct as recurring, stating, “Unbeknownst to the parents, this criminal pattern of taking the child away from the school to rape the child recurred multiple times in that month and thereafter.”

Court documents and reporting place the alleged grooming and abuse during the 2025‑26 fall semester and say Post used messaging to build trust with the student and to exceed “clearly established norms and boundaries for school employee‑student interaction.” The lawsuit accuses McKinney ISD of gross negligence for failing to provide transportation to the event and for insufficiently supervising Post’s interactions with the student.

The complaint also invokes a recent Texas law that went into effect September 1 allowing civil liability where a district is grossly negligent or reckless in hiring, supervising or failing to report suspected sexual misconduct by employees. The sources reporting that statute did not specify the year the law took effect.

Attorney Paul Herz of Herz Law represents the family; the firm provided contact information for inquiries: legal@herzlaw.com, 214‑745‑4567, 4835 LBJ Freeway #470, Dallas, TX 75244. Herz Law has also been involved in litigation representing families in other North Texas school sexual‑misconduct cases, according to firm materials.

McKinney ISD families were notified by the district about Post’s arrest the week of Jan. 28, and local coverage noted the arrest came amid other recent misconduct allegations in the district. Reporters seeking comment from McKinney ISD did not receive a reply at the time of reporting. The criminal arrest, the $1,000,000 civil demand filed Feb. 26 in Collin County, and the invocation of the new Texas law set the stage for parallel criminal and civil proceedings that will test district supervision policies and the scope of recent state changes to school liability.
