Under Indiana law, operating a vehicle with an ACE of .15 or greater is a Class A misdemeanor, carrying a maximum penalty of up to 365 days in jail and a $5,000 fine. The charge sits at the upper tier of Indiana's impaired-driving statutes. A reading below .15 but at or above .08 draws the lesser Class C misdemeanor designation, with a maximum of 60 days in jail and a $500 fine — meaning Wolf's alleged concentration places him in the more serious category by state standards.
ACE, or alcohol concentration equivalent, is a measure of the amount of alcohol in a person's blood.
