Four Tutto Italia cooks sue over alleged off-the-clock work

Four longtime cooks at Tutto Italia Ristorante in Walt Disney World’s EPCOT Italy Pavilion sought compensation after alleging they were forced to work off the clock. The claims put a high-volume theme-park kitchen under a labor spotlight familiar across restaurants: if cooks are finishing prep, closing down or staying late without paid time, the cost lands on hourly staff.

The dispute centered on Patina Group, which operates Tutto Italia in Orlando, Florida. Four Patina restaurant employees working in EPCOT’s Italy Pavilion demanded $134,449.72 in missing pay tied to years of alleged wage theft, including off-the-clock labor and unpaid overtime. The dollar figure gave the case a concrete measure of what unpaid minutes can add up to when a shift runs on speed and constant guest flow.

The allegations also drew a political response. Rep. Maxwell Frost sent a letter to the executive leadership of Delaware North seeking answers about claims that employees at Patina Group restaurants inside Disney’s EPCOT Italy Pavilion were not paid for all of the hours they worked over several years. That move widened the case beyond one kitchen, putting a third-party restaurant operator inside a major resort complex on notice that the issue had become a public labor complaint.

For restaurant workers, the mechanics matter. Off-the-clock claims often hinge on whether managers asked staff to arrive early, stay late or keep working after punching out. In a place like Tutto Italia, where service has to move quickly and schedules are tightly managed, those questions go straight to timekeeping records, overtime calculations and whether supervisors tracked actual labor or just the planned schedule.

The case also landed against a backdrop of labor tension at Patina Restaurant Group in Disney World. A Business Journals report from August 28, 2025, said workers planned a historic strike vote over wages and benefits, underscoring that the Italy Pavilion operation had already become a pressure point for front- and back-of-house staff.

Orlando Weekly had also reported that Disney EPCOT workers accused a third-party restaurant operator of wage theft, adding to the scrutiny around how labor is handled in the resort’s restaurant network. For cooks, servers and managers, the dispute is a reminder to keep copies of schedules, time-clock punches, texts about early arrivals or late closings, and any instructions that push work past the clock.
